The Cagayan de Oro City office of the Bureau of Internal Revenue has filed a criminal complaint with the Department of Justice against a cargo corporation for allegedly evading the payment of more than P210 million in taxes and for unlawful possession of counterfeit tax stamps.
The BIR said in a statement Cagayan de Oro City-based KDT Cargo Logistics Inc. and its board of directors failed to file excise tax returns, unlawfully removed the articles subject to excise tax without payment of tax and illegally possessed counterfeit Internal Revenue stamps in violation of Sections 236, 255, 263 and 265(c) of the National Internal Revenue Code of 1997 as amended (Tax Code).
The BIR said that results of the investigation conducted in March 2019 by National Bureau of Investigation found during the random testing “that the cigarette packs contained in the spin dryer labels have spurious or counterfeit internal revenue stamps which bear and carry the identical serial number on some brand of cigarettes or have no tax stamps.”
