Tokhang estopped: SC’s 2nd amparo out

THE Supreme Court on Tuesday issued a second writ of amparo with a protection order in favor of the family of an alleged drug pusher who was among the thousands who had been killed in the government’s war against illegal drugs.

The high court granted the plea sought by Christina Macandog-Gonzales, the widow of Joselito Gonzales who died of multiple gunshot wounds in Antipolo City on July last year.

The Temporary Protection Order from the Court overs the family of the victim.

Among the respondents in the petition were Interior Secretary Ismael Sueño, Philippine National Police Chief Ronald Dela Rosa, Chief Supt. Valfrie Tabian, Senior Supt. Adriano Enong and Supt. Simnar Semacio Gran.

The high court disallowed the respondents to enter the petitioner’s residence and work within a radius of one kilometer. It also remanded the case to the Court of Appeals and gave the respondents five working days to make a verified return.

The high court gave the appellate court 10 days after the hearing to issue a ruling.

In her petition,  Macandog-Gonzales claimed that  she and her husband­ ere induced by respondent police officers to deal in drugs.”

However, in mid-2016 they decided to surrender and reform but before they could do the same, two of the respondents threatened to kill them.

The petitioner said because of the threat, she had gone into hiding and left her child behind out of fear she would be killed next.

The Court issued the first writ of amparo and protection order to a survivor and his relatives during an anti-illegal drug operation in Payatas, Quezon City, in February last year.

The Court also referred the case to the appellate court, which after conducting a hearing ordered the transfer of the police officers named as respondents to an area outside Quezon City and Rizal.

The appellate court also made permanent the protection order on the petitioners.
