THE Court of Appeals has denied the appeal of Camarines Norte Governor Edgardo Tallado seeking to uphold his action transferring an employee from the Provincial Engineer’s Office to the Capalonga Medicare Community Hospital in 2014.
In a 12-page decision, the CA’s Ninth Division through Associate Justice Amy Lazaro-Javier dismissed Tallado’s petition seeking to nullify and set aside the issuances of the Civil Service Commission questioning his order to reassign Computer Operator IV Beverly Canlas to a community hospital.
Instead, the appellate court sustained the decision of the CSC declaring Tallado’s reassignment of Canlas as invalid.
“What Governor Tallado did to [Canlas] was not a job rotation but an invalid reassignment, devoid of any legal or factual justification,” the CA ruled. “Here, the obtaining circumstances invariably indicate that Governor Tallado acted in bad faith when he issued the reassignment in question,” the appellate court added.
Associate Justices Celia Librea-Leagogo and Melchor Sadang concurred with the ruling. Tallado’s decision to reassign Canlas came after photos depicting the governor, naked and kissing another woman, other than his wife, went viral on internet and tri-media in October 2014.
