THE Commission on Elections may issue writs of election to fill any vacancy in the Senate should a senator resign in disgrace or dies in office.
“The Comelec will hold a special election to fill a Senate vacancy,” said an official of Comelec’s Law Department, who asked not to be identified for lack of authority to speak on the matter. “The nearest or closest candidate to the last winning senatorial candidate cannot assume the vacancy unlike to local elected officials such as city councilors.”
He said only those candidates who ran but lost in the last election are allowed to run in the special election that should be held within 60 to 100 days after the vacancy occurs.
